Apenas dos horas después de estar cara a cara ante el juez Peinado, el presidente del Gobierno, a través de la Abogacía del Estado ha presentado una querella por prevaricación contra el magistrado. En un escrito de 35 folios la Abogacía justifica la querella en defensa de la institución de la Presidencia, que considera agraviada por la actuación del juez. La Abogacía asegura que no se trata de que no se investigue a alguien, sino la forma en la que está investigando el juez Peinado, que dice literalmente la querella "está orientada a otras finalidades, ajenas a las procesales, de manera que las decisiones del juez no pretenden ser eficaces sino aparatosas".
